In accordance with section 61B of the Charitable Trusts Act 1957, the trust deed will be given effect as if the part of clause 6(f) of the deed which states “for such other use as may be determined at the sole discretion of the Vicar” had been “blue-pencilled out”. The trustees have no authority to apply funds according to that part of clause 6(f).
